Brain death has been accepted worldwide medically and legally as the biological state of death of the organism. Nevertheless, the literature has described persistent problems with this acceptance ever since brain death was described. Many of these problems are not widely known or properly understood by much of the medical community. Here we aim to clarify these issues, based on the two intractable problems in the brain death debates. First, the metaphysical problem: there is no reason that withstands critical scrutiny (...) to believe that BD is the state of biological death of the human organism. Second, the epistemic problem: there is no way currently to diagnose the state of BD, the irreversible loss of all brain functions, using clinical tests and ancillary tests, given potential confounders to testing. We discuss these problems and their main objections and conclude that these problems are intractable in that there has been no acceptable solution offered other than bare assertions of an ‘operational definition’ of death. We present possible ways to move forward that accept both the metaphysical problem - that BD is not biological death of the human organism - and the epistemic problem - that as currently diagnosed, BD is a devastating neurological state where recovery of sentience is very unlikely, but not a confirmed state of irreversible loss of all [critical] brain functions. We argue that the best solution is to abandon the dead donor rule, thus allowing vital organ donation from patients currently diagnosed as BD, assuming appropriate changes are made to the consent process and to laws about killing. This study focuses on retraction notices from two major Latin American/Caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

Many clinical and psychological constructs are conceptualized to have multivariate higher-order constructs that give rise to multidimensional lower-order traits. Although recent measurement models and computing algorithms can accommodate item response data with a higher-order structure, there are few measurement models and computing techniques that can be employed in the context of complex research synthesis, such as meta-analysis of individual participant data or integrative data analysis. The current study was aimed at modeling complex item responses that can arise when underlying domain-specific, (...) lower-order traits are hierarchically related to multiple higher-order traits for individual participant data from multiple studies. We formulated a multi-group, multivariate higher-order item response theory (HO-IRT) model from a Bayesian perspective and developed a new Markov chain Monte Carlo (MCMC) algorithm to simultaneously estimate the (a) structural parameters of the first- and second-order latent traits across multiple groups and (b) item parameters of the model. Results from a simulation study support the feasibility of the MCMC algorithm. From the analysis of real data, we found that a bivariate HO-IRT model with different correlation/covariance structures for different studies fit the data best, compared to a univariate HO-IRT model or other alternate models with unreasonable assumptions (i.e., the same means and covariances across studies). Although more work is needed to further develop the method and to disseminate it, the multi-group multivariate HO-IRT model holds promise to derive a common metric for individual participant data from multiple studies in research synthesis studies for robust inference and for new discoveries. We call attention to the historical fact that the meaning of symmetry in antiquity—as it appears in Vitruvius’s De architectura—is entirely different from the modern concept. This leads us to the question, what is the evidence for the changes in the meaning of the term symmetry, and what were the different meanings attached to it? “De-Conditioning and Images of the Mind” explores the categories of Stephen Priest as developed in his article, “The Unconditioned Soul.” Through an analysis of historical and contemporary examples of the “conditioned” mode in recent philosophical and scientific discussions of the mind, the article articulates limitations of the proposed methods and advances examples of “de-conditioning” the mind that point in the direction of what Priest calls the “unconditioned.”.

Prenatal screening for foetal abnormalities such as Down's syndrome differs from other forms of population screening in that the usual aim of achieving health gains through treatment or prevention does not seem to apply. This type of screening leads to no other options but the choice between continuing or terminating the pregnancy and can only be morally justified if its aim is to provide meaningful options for reproductive choice to pregnant women and their partners. However, this aim should not be (...) understood as maximizing reproductive choice per se. Only if understood as allowing prospective parents to avoid suffering related to living with (a child with) serious disorders and handicaps can prenatal screening be a publicly or collectively funded programme. The alternative of moving prenatal testing outside the healthcare system into the private sector is problematic, as it makes these tests accessible only to those who can afford to pay for it. New developments in prenatal screening will have to be assessed in terms of whether and to what extent they either contribute to or undermine the stated aim of providing meaningful options for reproductive choice. In the light of this criterion, this article discusses the introduction of the new non‐invasive prenatal test (NIPT), the tendency to widen the scope of follow‐up testing, as well as the possible future scenarios of genome‐wide screening and ‘prenatal personalised medicine’. This paper concentrates on some aspects of the history of the analytic-synthetic distinction from Kant to Bolzano and Frege. This history evinces considerable continuity but also some important discontinuities. The analytic-synthetic distinction has to be seen in the first place in relation to a science, i.e. an ordered system of cognition. Looking especially to the place and role of logic it will be argued that Kant, Bolzano and Frege each developed the analytic-synthetic distinction within the same conception of scientific rationality, (...) that is, within the Classical Model of Science: scientific knowledge as cognitio ex principiis . But as we will see, the way the distinction between analytic and synthetic judgments or propositions functions within this model turns out to differ considerably between them. (shrink)

This article re-investigates the underlying values driving the rapidly growing rewilding movement in Europe and North America. In doing so, we respond to a common academic narrative that draws a sharp distinction between North American and European approaches to rewilding. Whereas the first is said to promote a colonial vision of wilderness, European rewilding is claimed to value a more inclusive notion of wildness. We challenge this narrative through a genealogical investigation into the wild(er)ness ideas that inspired rewilding, showing that (...) North American and European rewilding draw from similar philosophical sources with cross-continental origins. Thus, we contend that a linguistic shift from ‘wilderness’ to ‘wildness’ fails to engage substantively with the colonial critique it alleges to resolve. Through two case studies, we show how both wilderness and wildness concepts have been employed to support either colonialism or decolonial resistance and draw attention to the need to consider specific socio-political contexts when assessing rewilding. Ultimately, we propose that reclaiming a liberatory meaning of wild(er)ness, articulated in a critical tradition of wild(er)ness advocacy, will be an essential step in decolonising rewilding. The paper considers two main cases of how the creative arts can inform a greater appreciation of human dignity. The first case explores a form of theater, Commedia dell’Arte that has deep roots in Italian culture. The second recounts a set of theater exercises done with very minimal direction or self-direction in executive education and MBA courses at the Darden School, University of Virginia, in the United States. In both cases we highlight how the creative arts can be important for (...) promoting human dignity in organizations, and how they can lead to a more authentic conversation about values, ethics, and meaning. Quine's well-known ‘Two Dogmas of Empiricism’ (1951) plays a key role in the debate about the analytic-synthetic distinction. Taking to task the ideas of Carnap in particular, Quine shows that logical positivism works with a concept of scientific rationality that is based dogmatically on, among other things, the opposition analytic-synthetic.

Kant's distinction between analytic and synthetic method is connected to the so-called Aristotelian model of science and has to be interpreted in a (broad) directional sense. With the distinction between analytic and synthetic judgments the critical Kant did introduced a new way of using the terms 'analytic'-'synthetic', but one that still lies in line with their directional sense. A careful comparison of the conceptions of the critical Kant with ideas of the precritical Kant as expressed in _Ãœber die Deutlichkeit, leads (...) to the interpretation defended here of Kant's distinction between analytic and synthetic judgments within his philosophy of mathematics. There is much interest in investigating the evolution question: How did consciousness evolve? In this paper, we evaluate the role that evolutionary considerations can play in justifying (i.e., confirming or falsifying) hypotheses about the origin, nature, and function of consciousness. Specifically, we argue against what we call evolution-first approaches to consciousness, according to which evolutionary considerations provide the primary and foundational lens through which we should assess hypotheses about the nature, function, or distribution of consciousness. Based on the example of (...) Walter Veit's account and additional reasoning, we contend that evolution-first approaches struggle to provide compelling empirical evidence for their key claims about consciousness. In contrast with these approaches, we argue that consciousness science needs to foundationally rely on experimental and observational evidence from humans and other present-day animals. If our arguments succeed, then researchers, when investigating consciousness, are better advised to take as their primary source of evidence consciousness’ present, not its past. Having said this, we acknowledge that evolutionary thinking plays an important role in consciousness science. We delineate this role by stressing several ways in which evolutionary considerations can substantially help advance consciousness research, although in a manner that avoids the evolution-first approach. Since our argument only concerns the assessment of hypotheses (the “context of justification”), it leaves it open which role evolutionary considerations play in generating hypotheses (the “context of discovery”). That is, evolutionary considerations may nevertheless play a foundational role in hypothesis generation in consciousness science. (shrink)

This paper analyses the relationship between Hobbes's theory of language and his theory of science and method. It is shown that Hobbes, at least in his Computatio sive Logica (1655), deviates in some measure from the traditional (Aristotelian) model of language. In this model speech is considered to be a fairly unproblematic expression of thought, which itself is independent of language. Basing himself on a nominalist account of universals, Hobbes states that the demonstration or assertion of universal propositions presupposes speech (...) (more especially, the use of names as marks). This insight turns out to be essential for Hobbes's (rationalist) view of scientific method. (shrink)

The underlying psychological processes that enable framing effects are often described as cognitive. Yet, recent studies suggest that framing effects may also be mediated by emotional response. The role of specific emotions in mediating the framing effect process, however, has yet to be fully empirically investigated. In an experimental survey design, this study tests two positive and two negative emotions as mediators of framing effects. Our results show that while anger and enthusiasm mediate a framing effect, contentment and fear do (...) not. These findings deepen our understanding of which discrete emotions are relevant when studying mediated framing effects. (shrink)

Ḍırār b. ʿAmr ve ʿAbdullāh b. Yezīd el-Fezārī, dönemlerinin önde gelen kelâmcıları arası yer almışlardır. Onlara dair bilgilerimiz çok uzun bir süre sadece makâlât ve tarih kitaplarındaki anlatımlara dayanıyordu. Yakın tarihimizde bu eksikliği gideren gelişmeler oldu. Ḍırār’ın günümüze intikal eden ilk ve tek eseri olan Kitābu’t-Taḥrīş, 2014 yılında neşredildi. Bu eser, doğrudan kelâm alanıyla ilgili olmasa da mezheplerin dağılımı ve fikirleri hakkında bilgiler ihtiva eden en eski Muʿtezilî kaynaklar arasında yer almaktadır. Ḍırār bu kitabında farklı dinî grupların rivâyetleri birbirlerine karşı (...) nasıl kullanıp suistimal ettiklerini konu edinmiştir. Eserin özelliği sadece ihtiva ettiği rivâyetlerde değil, meseleyi ele alış ve anlatım tarzında da bulunuyor. Ḍırār bu çalışmasıyla sonraki nesilleri birçok yönden etkilemiştir. ʿAbdullāh b. Je soutiens que cette affirmation fait partie d'une explication de la façon dont la phénoménologie des jugements esthétiques familiers appuie son affirmation selon laquelle les jugements de goût sont universels. La théorie esthétique de Kant n'est plausible que si nous rejetons l'affirmation répandue selon laquelle cette exigence est normative. Je propose une lecture non normative des jugements de goût kantiens basée sur une étude des textes, (...) puis je conteste les trois interprétations normatives importantes, qui nous obligent à attribuer à Kant une position qu'il n'acceptait pas. The main current application of placebo is in clinical research. The term placebo effect refers to diverse non-specific, desired or non-desired effects of substances or procedures and interactions between patient and therapist. Unpredictability of the placebo effect necessitates placebo-controlled designs for most trials. Therapeutic and diagnostic use of placebo is ethically acceptable only in few well-defined cases. While "therapeutic" application of placebo almost invariably implies deception, this is not the case for its use in research. Conflicts may exist between the (...) therapist's Hippocratic and scientific obligations. The authors provide examples in neuropsychiatry, illustrating that objective scientific data and well-considered guidelines may solve the ethical dilemma. Placebo control might even be considered an ethical obligation but some provisos should be kept in mind: (a) no adequate therapy for the disease should exist and/or (presumed) active therapy should have serious side-effects; (b) placebo treatment should not last too long; (c) placebo treatment should not inflict unacceptable risks, and (d) the experimental subject should be adequately informed and informed consent given. Denne artikkelen tar utgangspunkt i et skille mellom samfunnsstrukturer som avgrenser legers skjønnsmessige utfoldelse på den ene siden, og profesjonens tilrettelegging for kultiveringen av erkjennelsesmessige ferdigheter på den annen. Ved å videreføre H. Grimen og A. Molanders anvendelse av S.E. Toulmins modell for praktisk resonnering i en klinisk kontekst redegjør jeg for legeskjønnets multidimensjonale, epistemiske struktur. Gjennomgangen viser hvordan skjønnsanvendelse i legerollen kan analyseres i henhold til en fagteknisk, en distributiv og en relasjonell dimensjon. Mot denne bakgrunnen diskuterer jeg så (...) spenninger som oppstår i skjæringspunktet mellom strukturering og kultivering av skjønnets ulike dimensjoner. Diskusjonen tydeliggjør at den medisinske profesjonen ikke kan betraktes som en selvtilstrekkelig premissleverandør når det gjelder å sikre adekvat kultivering av medlemmenes skjønnsutøvelse i en klinisk kontekst. By developing H. Grimen and A. Molander's application of S.E. Toulmin's model for practical reasoning in a clinical context, the multi-dimensional epistemic structure of the physician's judgment in terms of technical, distributive, and relational judgment is accounted for. Against this backdrop, tensions emerging in the intersection between delimitation and cultivation of professional judgment in its various dimensions are discussed. The discussion clarifies that the medical profession is not a self-sufficient provider when it comes to ensuring an adequate cultivation of its members' judgment in a clinical context. It is argued that by emphasising and implementing the relevant external contributions to the profession's ongoing self-regulation, the public's justified trust in the medical profession can be strengthened. Ethical arguments about caregiver responsibility and the limits of client autonomy rely on best evidence about the risks and benefits of medical interventions. But when the evidence is unclear, or when the peer-reviewed literature presents conflicting accounts of the evidence, how are clinicians and their clients to recommend or decide the best course of action? Conflicting evidence about the outcomes of home and hospital birth in the peerreviewed literature offers an opportunity to explore this question. We present the contrary evidence (...) and describe the social and cultural elements that influence the production of the science of birth, including professional, publication, and critical bias. We then consider how the science of birth has been used an misused in making ethical arguments about preferred place of birth. We conclude with a number of recommendations about the responsible use of the evidence, arguing for an “ethics of information” that can be drawn on to guide caregivers and clients in the use of evidence for clinical decision making. We theorize that, in the current development of business ethics, there is a fruitful evolution that dissolves the dichotomy between the normative and behavioral research approaches developed, respectively, by philosophers and social scientists; this approach avoids many of the limitations originated by such distinction by reconnecting their two separate narratives. We call this emerging research model Humanistic Business Ethics (HBE) as it emphasizes the centrality of the human dimension of business and the importance of adopting a richer concept of humanity (...) in business ethics research. We argue that this specific research model in business ethics emerges when scholars combine a pragmatist philosophical approach with some key ideas coming from stakeholder theory, which we summarize and connect. By leveraging collaboration across ethics, economics, psychology, and entrepreneurship, HBE can help business and society scholars undertake fruitful inquiries into the way business works (and should work) at its best. In the ancient Arabic dictionaries, the root “ḍ-r-r” has three main meanings: “to harm”, “to gather” and “strength”. In the course of history, many words have been derived from these root meanings and have acquired various meanings. In the present article, the words derived from the root “ḍ-r-r” are semantically analyzed. First, the etymological origins of the root as well as its compounds and their meanings in early Arabic dictionaries are analyzed. In this context, it was aimed to determine the (...) literal and figurative meanings they acquired over time. In doing so, Arabic poetry of the Jahiliyyah period and hadiths were also utilized. Afterwards, in order to determine the semantic meaning pattern of the root “ḍ-r-r” and its compounds, words containing antonymous and proximate meaning relations with this root were included and their semantic relations were compared. While words have “essential meanings” that they always carry and do not lose no matter which system they enter, there are also “relative meanings” that do not originate from the root of words but arise from the system of relations they are in. For this reason, in the next stage, it was aimed to determine the relative meanings of the related words in the Qur’anic context by including the uses of the root “ḍ-r-r” and its derivatives in the Qur’an. Finally, various uses of words that have a semantically antonymous or proximate relationship with the root “ḍ-r-r” and its de-rivatives in the Qur’an were presented and their semantic pattern was tried to be determined. In this rather technical paper we establish a useful combination of belief revision and verisimilitude according to which better theories provide better predictions, and revising with more verisimilar data results in theories that are closer to the truth. Moreover, this paper presents two alternative definitions of refined verisimilitude, which are more perspicuous than the algebraic version used in previous publications.

The need for urgent, structural transformations to dominant food systems is increasingly recognized in research and policy. The direction these transformations take is in great part influenced by how the problem is framed and what future pathways become seen as plausible and desirable. Scientific knowledge and the organizations producing it hold considerable authority in suggesting what alternatives are or are not worth pursuing, ultimately shaping frames and in turn being shaped by them. This paper examines Brazil’s federal Agricultural Research Corporation (...) (Embrapa), a major contributor to technological advances that made Brazil into an agricultural powerhouse. We examine the ways in which Embrapa’s leadership has framed sustainable agriculture in its public communication and the wider implications for food systems transformation. Drawing from Embrapa news articles in the period 2015–2020, we identify four interrelated frames forming Embrapa’s prevalent position on sustainability. Our results show that while Embrapa promotes practices based on alternative approaches such as agroecology, its deeper framing often reflects the core assumptions driving dominant industrial food systems. This framing reinforces underlying logics of control, efficiency, and competition aligned with the productivist paradigm and excludes divergent perspectives that exist within the organization. Reserva uma parte significativa a combater três “erros” de Marsílio de Pádua: as afirnações de que o papa pode ser julgado pelo imperador, que o poder do papa não é superior ao de qualquer presbitero e que, morto o papa, o poder retorna ao imperador. Estuda-se a maneira como tais afirmações são refutadas e conclui-se que Álvaro não dispunha do texto marsiliano, e sim (...) de reportação do mesmo e que repete nessa obra o que já escrevera em outra. There is much interest in investigating the evolution question: How did consciousness evolve? In this paper, we evaluate the role that evolutionary considerations can play in justifying (i.e., confirming or falsifying) hypotheses about the origin, nature, and function of consciousness. Specifically, we argue against what we call evolution-first approaches to consciousness, according to which evolutionary considerations provide the primary and foundational lens through which we should assess hypotheses about the nature, function, or distribution of consciousness. Based on the example of (...) Walter Veit's account and additional reasoning, we contend that evolution-first approaches struggle to provide compelling empirical evidence for their key claims about consciousness. In contrast with these approaches, we argue that consciousness science needs to foundationally rely on experimental and observational evidence from humans and other present-day animals. If our arguments succeed, then researchers, when investigating consciousness, are better advised to take as their primary source of evidence consciousness’ present, not its past. Having said this, we acknowledge that evolutionary thinking plays an important role in consciousness science. We delineate this role by stressing several ways in which evolutionary considerations can substantially help advance consciousness research, although in a manner that avoids the evolution-first approach. Since our argument only concerns the assessment of hypotheses (the “context of justification”), it leaves it open which role evolutionary considerations play in generating hypotheses (the “context of discovery”). That is, evolutionary considerations may nevertheless play a foundational role in hypothesis generation in consciousness science. (shrink)

Understanding of organizational ethics phenomena requires complex understanding of organizational practices in their real world contexts. We can try to understand and build theory about these complex real world practices from the points of view of: a traditional deductive, ethics literature-based, literature gap formulation approach; or, an inductive, practitioner-based literature gap formulation approach. This consideration of inductive, practitioner-based versus deductive, literature-based literature gap formulation is related to the discussion concerning “engaged scholarship” and relationships and gaps between theory and practice in (...) organization studies [Van De Ven, 2007, Engaged Scholarship: A Guide for Organizational and Research Knowledge ]. However, there is an important difference with respect to the key issue of ethics literature versus practitioner-based literature gap formulation. This article offers examples of the two different approaches and makes comparisons between them. Implications for practice-based organizational ethics theory building, Ph.D. education, and public intellectual work are considered. (shrink)

There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

As was first pointed out by Gercke, there are close parallels, which clearly suggest a common source, between Apuleius, de Platone 1.12, the treatise On Fate falsely attributed to Plutarch, Calcidius' excursus on fate in his commentary on Plato's Timaeus, and certain sections of the treatise de Natura hominis by Nemesius. Gercke traced the doctrines common to these works to the school of Gaius; recently however Dillon has pointed out that, while Albinus shares with these works the characteristic Middle-Platonic notion (...) of fate as conditional or hypothetical – our actions are free, but once we have acted the consequences of our actions are fated and inevitable – he does not share certain other common features, such as the identification of fate as substance with the world-soul and the hierarchy of three providences. In this paper we study in details a system of two weakly coupled harmonic oscillators from the point of view of Bohm’s interpretation of quantum mechanics. This system may be viewed as a simple model for the interaction between a photon and a photodetector. We obtain exact solutions for the general case. We then compute approximate solutions for the case where one oscillator is initially in its first excited state (a single photon) reaching the other oscillator in its ground state (...) (the photodetector). The approximate solutions represent the state of both oscillators after the interaction, which is not an eigenstate of the individual hamiltonians for each oscillator, and therefore the energies for each oscillator do not exist in the Copenhagen interpretation of Quantum Mechanics. We use the approximate solutions that we obtained to compute Bohmian trajectories and to study the energy transfer between the oscillators. We conclude that, even using the Bohmian view, the energy of each individual oscillator is not well defined, as the nonlocal quantum potential is not negligible even after the coupling is turned off. Despite widespread and worldwide efforts to eradicate vector-borne diseases such as malaria, these diseases continue to have an enormous negative impact on public health. For this reason, scientists are working on novel control strategies, such as gene drive technologies (GDTs). As GDT research advances, researchers are contemplating the potential next step of conducting field trials. An important point of discussion regarding these field trials relates to who should be informed, consulted, and involved in decision-making about their design and launch. It (...) is generally argued that community members have a particularly strong claim to be engaged, and yet, disagreement and lack of clarity exist about how this “community” should be defined and delineated. In this paper, we shed light on this “boundary problem”: the problem of determining how boundaries of inclusion and exclusion in (GDT) community engagement should be drawn. As our analysis demonstrates, the process of defining and delineating a community is itself normative. First, we explicate why it is important to define and delineate the community. Second, we demonstrate that different definitions of community are used and intermingled in the debate on GDTs, and argue in favor of distinguishing geographical, affected, cultural, and political communities. Finally, we propose initial guidance for deciding who should (not) be engaged in decision-making about GDT field trials, by arguing that the definition and delineation of the community should depend on the rationale for engagement and that the characteristics of the community itself can guide the effective design of community engagement strategies.
